What is a Homeowners Association?
Every
planned community has covenants and amenities that enhance the living experience
of homeownership and protect the value of your investment in your home.
Our association is incorporated and referenced by deed restrictions to give the
necessary governing body the authority to preserve our community to the benefit
of the property owners.
Additionally the
Homeowners Association manages the Architectural Review Board which manages the
appearance of the subdivision and the behavior of residents and guests. No one
wants someone next door raising farm animals or building a permanent shed in
their front yard. The Architectural Review Board receives requests for changes
to properties, responds to complaints by owners and enforces the restrictive
covenants and items contained in the master declaration.
Does everyone have to join?
Everyone by
ownership of property in Westerfield Farms is a member of the Homeowners
Association; when you bought your home your realtor explained to you that your
purchase deed contained language accepting membership and support of the
organization.
What does my dues pay for?
In addition
to the support of the organization operating costs, there are common areas within
the subdivision that are maintained by the Homeowners Association. When you
enter the subdivision the flag pole, bushes, lights, flags, etc., are all
provided and maintained by the Homeowners Association.
When are the dues usually due?
After the annual meeting when the dues are
assessed a notice is send out. Annual dues are due on the 1st of every year.
We will send out a 2nd notice in January reminding everyone of the dues.
After that the dues are delinquent and late fees and interest will be charged.
How do I know what it will cost each year?
Each year a budget is prepared by the staff and
submitted to the Board of Directors for approval. When the board approves the
budget it is then presented to the members at an annual meeting. You will
receive a copy of the budget each year upon request or you can download from the web
site.
What if I have a complaint because my neighbor is
burning old tires at night?
Your homeowners association will accept the
complaint and either contact the necessary authorities or will take legal action
on behalf of the Homeowners Association.
What if some of my neighbors refuse the pay the
dues?
The Homeowners Association has the legal
authority to demand payment and then take legal action to affect a lien on their
property, with interest and penalties until it is paid in full. Additionally,
any legal fees incurred by the Homeowners Association will be added to the
moneys owed by the person refusing to comply with the requirement to pay dues.
If I leave and rent my house out will I still
have to pay dues?
Yes, the requirement rests with the property
owner and runs with the land. As long as you hold title to the property you and
your tenants are bound by the terms of the covenants.
